2. Information We Collect
Information you provide to us
When you place an order, create an account, subscribe to our newsletter, submit a product review, or contact us, we may collect your name, email address, shipping and billing address, phone number, and payment information.
Payment card details are processed directly by Stripe and are not stored on our servers. We receive only a transaction confirmation and the last four digits of your card.
Information collected automatically
When you visit our website, we automatically collect certain information about your device and browsing activity, including your IP address, browser type, operating system, referring URLs, pages viewed, and the dates and times of your visits. 3. Legal Basis for Collecting Your Information
We collect and use your personal information on the following bases:
Contractual necessity โ to process your orders, arrange shipping, handle returns, and manage your account. Without this information we cannot fulfil your purchase.
Consent โ for marketing emails and newsletters, you have actively opted in. For non-essential cookies (analytics and advertising), you have provided consent through our cookie consent tool. You may withdraw either form of consent at any time.
Legitimate interests โ to analyse how our website is used, prevent fraud, and improve our products and services, in ways that do not override your privacy rights.
Legal obligation โ to retain certain records (such as transaction data) as required by Canadian tax and accounting law.
4. How We Use Your Information
We use the information we collect to fulfil and manage your orders, including processing payments, arranging shipping, and sending order confirmations and updates. We use it to communicate with you about your account, respond to your enquiries, and notify you of changes to our policies. If you have opted in to our newsletter, we use your email address to send you marketing communications about new products, promotions, and yoga-related content. We use automatically collected data to analyse website performance, improve our services, and prevent fraud.
5. How We Share Your Information
We do not sell, rent, or trade your personal information to third parties.
We share your information only with trusted third-party service providers who help us operate our business. Each provider is contractually required to handle your information securely and only for the purposes we specify. These providers include:
Stripe โ payment processing. Your payment information is transmitted directly to Stripe and is never stored on our servers. Stripe’s privacy policy is available at stripe.com/privacy.
Shipping carriers โ to deliver your orders, we share your name, shipping address, and phone number with the carrier fulfilling your shipment.
Omnisend โ our email marketing platform. If you have subscribed to our newsletter or marketing emails, your name and email address are stored with Omnisend to manage and deliver those communications. Omnisend’s privacy policy is available at omnisend.com/privacy.
Google Analytics โ we use Google Analytics to understand how visitors use our website. Data collected is aggregated and does not identify you personally. Google’s privacy policy is available at policies.google.com/privacy.

CookieYes โ we use CookieYes to manage cookie consent on our website. CookieYes records your consent preferences and stores a log of consent for compliance purposes. CookieYes’ privacy policy is available at cookieyes.com/privacy-policy.
We may also disclose your personal information if required by law, court order, or governmental authority, or where we reasonably believe disclosure is necessary to protect our rights, your safety, or the safety of others.
6. Cross-Border Data Transfers
Some of the third-party service providers listed above โ including Stripe, Google Analytics, Meta, Omnisend, Wiser Reviews, and CookieYes โ are based in the United States or other countries outside Canada. When your personal information is transferred to these providers, it may be subject to the laws of those countries, including laws that may permit government access to personal information without notice.
We take reasonable steps to ensure that any personal information transferred outside Canada receives a comparable level of protection, including through contractual obligations with our service providers.
We currently fulfil orders within Canada only. If we begin shipping internationally in the future, we will update this policy to reflect any additional cross-border data considerations.
7. Cookies and Consent
We use cookies and similar tracking technologies on our website. Non-essential cookies โ including analytics and advertising cookies โ are only activated after you provide explicit consent through our cookie consent tool (CookieYes), which is presented when you first visit our site.

8. Marketing Communications & CASL
We send marketing emails only to customers who have expressly opted in, in compliance with Canada’s Anti-Spam Legislation (CASL). You may withdraw your consent at any time by clicking “unsubscribe” in any of our emails or by contacting us at contact@modernyogi.ca. We will process your request promptly and you will not receive further marketing emails.
9. Data Retention
We retain your personal information for as long as necessary to fulfil the purposes for which it was collected, including to meet legal, accounting, and reporting requirements.
Order and transaction records are retained for a minimum of seven years in accordance with Canadian tax law. Account information is retained until you request its deletion. If you unsubscribe from our marketing emails, your email address will be removed from our active marketing list promptly, though a record of your unsubscribe request will be kept to ensure we do not contact you again.
10. Your Rights Under Canadian Privacy Law
Under PIPEDA, you have the right to:
- Know what personal information we hold about you and how it is used
- Access your personal information upon written request
- Request correction of inaccurate or incomplete information
- Withdraw consent for collection or use of your personal information, subject to legal or contractual limitations

Quebec residents have additional rights under Law 25, including:
- Data portability โ the right to receive your personal information in a structured, commonly used technological format
- De-indexation โ the right to request that we cease disseminating your personal information or de-index any hyperlinks associated with your name where that information could cause you harm
- Automated decision-making โ the right to be informed if your personal information is used in automated decision-making, and to request human review

11. Data Breach Notification
In the event of a breach of security safeguards involving your personal information that poses a real risk of significant harm, Modern Yogi Limited will notify you and the Office of the Privacy Commissioner of Canada as soon as feasible, in accordance with PIPEDA’s Breach of Security Safeguards Regulations. We maintain internal procedures to detect, contain, and respond to security incidents promptly.
12. Children’s Privacy
Our website is intended for individuals who are 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we become aware that personal information has been collected from a person under 18, we will take immediate steps to delete it. Payments are processed by Stripe using industry-standard security measures, and your card details are never stored on our servers.
No method of transmission over the internet is completely secure. While we work hard to protect your information, we cannot guarantee its absolute security.
